Burning the Constitution

Before I start this, I need ya’ll to understand that this article is based on the SENATE bill S1867

Before the law can be actually signed, congress must put forward their own bill, then the different language between the two bills must be reconciled into one single document

I’m hoping that I can find a way to convince congress to write a better set of words that conform to the Constitution in their version of the bill

This bill is even more unConstitutional than the Patriot Act by violating the 4th and 6th amendments

I’m against it. The Albany Tea Party is against it. The other Tea Parties are against it (well, the ones that haven’t sold out yet), and I’d be willing to bet that the Occupiers are against it too

Let’s see if you can follow me around the mulberry bush while we try to unravel this mess…

Let’s start with section 1032…

REQUIREMENT FOR MILITARY CUSTODY

(1) IN GENERAL- Except as provided in paragraph (4)

Whoops, so, we gotta stop right there and jump to paragraph 4, which says…

(4) WAIVER FOR NATIONAL SECURITY

So, right off the bat, the first thing they say is that they can use a waiver and ignore all the rules. Next line

The Secretary of Defense may” (translated as ‘can if he wants to’) in consultation with the Secretary of State and the Director of National Intelligence, waive the requirement of paragraph (1)

So now we have to go back to paragraph 1 and see what the rest of it says…

the Armed Forces of the United States shall hold a person described in paragraph (2)

And now back to paragraph 2

(2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1031 who is determined–

And now back to section 1031 to see WHO is covered…

SEC. 1031. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.

(b) Covered Persons- A covered person under this section is any person as follows:

(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.

Okay, this part is clear and concise. Anybody who participated in Sept 11 events. This sounds reasonable, doesn’t it ? But then they go on to say…

(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

It starts out by SPECIFICALLY listing al-Qaeda and the Taliban, which is fine, but, then it goes on to add “or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act

So now it’s including individuals OTHER than al-Qaeda and the Taliban, and it goes on to mention “belligerent acts”, but they don’t say what a belligerent act IS, so we need to find that language elsewhere, like, the belligerent acts law (2010 S3081 Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010)

Notice that this bill is ALSO thanks to McCain, and we only need one sentence to figure out where to look next

Requires an individual who is suspected of engaging in hostilities against the United States or its coalition partners through an act of terrorism

“SUSPECTED”, IE, no proof, just suspected, and…

“act of terrorism”

So now we have to look to see how they define acts of terrorism, and who might be a terrorist, which leads directly to a set of jokes that Jeff Foxworthy NEVER told in the Domestic Terrorist Watch List of 2009

Above ground – Term used to describe extremist groups or individuals who act within the law

Think about this one, “you might be a terrorist IF… you obey the law”

What other nice language is in there ?

Alternative media- Various information sources that provide a forum for interpretations of events and issues that differ from those presented in mass media

You might be a terrorist IF you’re not CNN or MSNBC

Or, maybe the VP could just declare your group a terrorist organization…

But I digress…

Yes, those words are in there. “opposed to illegal immigration

Notice how it doesn’t say that they have to actually PERFORM an act of terrorism ? They’re just LABELING these people without actually ACCUSING them of any wrongdoing

The 6th Amendment says “to be informed of the nature and cause of the accusation

(Section 1031 cont)

(c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following:

(1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.

Now, this is not me reading between the lines. It’s written this way on purpose, “until the end of hostilities

When does the war on terror end ?

Is there a terrorist prezident who has the authority above all the other terrorists to officially surrender on behalf of the entire group ?

I printed an article a few years ago about the Domestic Home Land Terrorist Watch List

I’m reprinting it today due to S1867 so that people have an idea of just who might be about to “vanish”, and why

Subsequent articles in this series will not doubt cover the Patriot Act and S1867

Part 1.

A friend of mine just mentioned that he’s already on the DHS watchlist, so I got to wondering just how many times am I on that list ?

Before I continue, I must give a warning about my language on this one
