DHS WatchList (Pt 2) the NDAA

Written by Spyder on December 10th, 2011
Summary:

The government has officially gone insane

Burning the Constitution

Burning the Constitution

Before I start this, I need ya’ll to understand that this article is based on the SENATE bill S1867

Before the law can be actually signed, congress must put forward their own bill, then the different language between the two bills must be reconciled into one single document

I’m hoping that I can find a way to convince congress to write a better set of words that conform to the Constitution in their version of the bill

This bill is even more unConstitutional than the Patriot Act by violating the 4th and 6th amendments

I’m against it. The Albany Tea Party is against it. The other Tea Parties are against it (well, the ones that haven’t sold out yet), and I’d be willing to bet that the Occupiers are against it too

Let’s see if you can follow me around the mulberry bush while we try to unravel this mess…

Let’s start with section 1032…

REQUIREMENT FOR MILITARY CUSTODY

(1) IN GENERAL- Except as provided in paragraph (4)

Whoops, so, we gotta stop right there and jump to paragraph 4, which says…

(4) WAIVER FOR NATIONAL SECURITY

So, right off the bat, the first thing they say is that they can use a waiver and ignore all the rules. Next line

The Secretary of Defense may” (translated as ‘can if he wants to’) in consultation with the Secretary of State and the Director of National Intelligence, waive the requirement of paragraph (1)

So now we have to go back to paragraph 1 and see what the rest of it says…

the Armed Forces of the United States shall hold a person described in paragraph (2)

And now back to paragraph 2

(2) COVERED PERSONS- The requirement in paragraph (1) shall apply to any person whose detention is authorized under section 1031 who is determined–

And now back to section 1031 to see WHO is covered…

SEC. 1031. AFFIRMATION OF AUTHORITY OF THE ARMED FORCES OF THE UNITED STATES TO DETAIN COVERED PERSONS PURSUANT TO THE AUTHORIZATION FOR USE OF MILITARY FORCE.

(b) Covered Persons- A covered person under this section is any person as follows:

(1) A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.

Okay, this part is clear and concise. Anybody who participated in Sept 11 events. This sounds reasonable, doesn’t it ? But then they go on to say…

(2) A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

It starts out by SPECIFICALLY listing al-Qaeda and the Taliban, which is fine, but, then it goes on to add “or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act

So now it’s including individuals OTHER than al-Qaeda and the Taliban, and it goes on to mention “belligerent acts”, but they don’t say what a belligerent act IS, so we need to find that language elsewhere, like, the belligerent acts law (2010 S3081 Enemy Belligerent, Interrogation, Detention, and Prosecution Act of 2010)

Notice that this bill is ALSO thanks to McCain, and we only need one sentence to figure out where to look next

Requires an individual who is suspected of engaging in hostilities against the United States or its coalition partners through an act of terrorism

“SUSPECTED”, IE, no proof, just suspected, and…

“act of terrorism”

So now we have to look to see how they define acts of terrorism, and who might be a terrorist, which leads directly to a set of jokes that Jeff Foxworthy NEVER told in the Domestic Terrorist Watch List of 2009

Above ground – Term used to describe extremist groups or individuals who act within the law

Think about this one, “you might be a terrorist IF… you obey the law”

What other nice language is in there ?

Alternative media- Various information sources that provide a forum for interpretations of events and issues that differ from those presented in mass media

You might be a terrorist IF you’re not CNN or MSNBC

Or, maybe the VP could just declare your group a terrorist organization…

But I digress…

Anti-immigration- Groups or individuals who are vehemently opposed to illegal immigration

Yes, those words are in there. “opposed to illegal immigration

Decentralized terrorist movement- groups or individuals who pursue shared ideological goals through tactics of leaderless resistance independent of any larger terrorist group

Notice how it doesn’t say that they have to actually PERFORM an act of terrorism ? They’re just LABELING these people without actually ACCUSING them of any wrongdoing

The 6th Amendment says “to be informed of the nature and cause of the accusation

(Section 1031 cont)

(c) Disposition Under Law of War- The disposition of a person under the law of war as described in subsection (a) may include the following:

(1) Detention under the law of war without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.

Now, this is not me reading between the lines. It’s written this way on purpose, “until the end of hostilities

When does the war on terror end ?

Is there a terrorist prezident who has the authority above all the other terrorists to officially surrender on behalf of the entire group ?

As is always the case with the DailySok, censure of comments is deplorable to us. If you like, you can post a comment just to call me names, but, I would prefer if you keep the comments on subject.

Comments touting your condo for sale in Florida WILL be censured along with your Viagra ads

Comments calling the Tea Party nazis will be posted

Comments calling the Albany Tea Party nazis will be ridiculed

So, who are you, and how much do you love this bill ?

Spyder, I have read many articles about the bill and this is hands down the best, most informative, with actual language from the bill, and I really appreciate it.

  2. Lentenlands says:

    Hate and oppose this bill.

This unConstitutional madness is a further unlawful attempt by the sell out rats in Washington (that do not represent We the People) to dissolve our unalienable Liberties in favor of some unobtainable concept (yet from the tyrannical State’s view, politically expedient selling point) of security. What did Franklin say about this kind of thing being clamored at by those deserving neither?

And this ends up being the ploy of every degrading dictatorial Police State in history, that it must turn against its own Citizens and create problems to solve; it launches, aids and abets the perceived ‘enemy’ in false flag terror operations to consolidate its own power, much as the volunteer firefighter that commits arson to be counted a hero in the local papers. I will not even belabor the issue of the amazing volume of real scientific questions of the ridiculous and disingenuous NIST report that concluded that the 47 story skyscraper known as World Trade Center 7 collapsed due to fires from “office furniture” on 9/11/2001. Yeah, right.

In the case of NADA, these non-representatives have chosen to violate essential Liberties and unlawfully invoke military action upon our Republic’s soil, undoing Posse Comitatus and the rule of law at the same time.

This bill is so grievous as to practically signal a death knell for the once so great and free American Republic.

  3. Chris says:

Don’t worry Spyder, the weather down there in Guantanamo is great. You will love it

  4. Kevin H says:

If there was ever a piece of legislation that all of us – no matter how we self-identify – should oppose, this is it. I’m a progressive and a participant in Occupy and I’m sickened by this bill and by the Senate’s overwhelming support for it.

Yeah, the way to ‘win’ the war on terrorism is to completely gut the rights of American citizens — hot damn, THAT’LL show’em.

  5. Jack says:

I second what Kevin said above.
I consider myself an independent, progressive on domestic policy & conservative on foreign policy.
Leaving this so wide open to interpretation for the convenience of those in control, to say nothing of even thinking it, much less enacting it, is indeed INSANE.
History has already shown just how unpopular & counterproductive suspending habeus corpus is.
We ALL need to tell our congress critters we want them voting this DOWN!!

  6. Pope Jay says:

Excellent article spyder;and I’ve been saying since the beginning, OWS and the Tea Party need to join forces…. despite what the mass media wants us to believe about each other… If our goals are to protect this country and our constitution, then now is the time if ever to sweep the left right nonsense aside… A bunch of fascist pigfuckers have just undermined everything we stand for as americans, and this cannot be allowed to stand… We see what a police state this is becoming, as every instance appears more horrifically Orwellian than the average american is willing to accept, for reasonable threat to ones own comfort zone… It is my belief however, and where some of us may disagree; that we can vote all we want… It will not do a whole lot of anything… Things are about to get very ugly, and if there’s one thing we learned at OWS, peaceful protests are regarded as “week and pointless” by heavily armed cops… and their billionaire puppet masters, who appear to want nothing more than do shit on the chest of the american dream, and lock us all away in fema camps… I don’t condone violence, but over the last ten years, (some may disagree and state 200 years) we have been hijacked by true terrorists, gung ho on destroying america from the inside out… now at the current hour it is almost too late… Many of us, who had been pegged as fringe conspiracy theorists, are now wishing we were as batshit crazy as so many have argued in the past; are now deeply disturbed to find out that the road to the New world order has only now presented us with a sign that says “Last stop America, Welcome to Big brother country….”

So… The time for voting is done (IMO) they don’t give a fuck about us or our vote, and they don’t represent us… Hell, they drafted the whole heretical bill in secret, and kept it far from the public… What about that SOPA bill? anyone hear about that? well they have extreme corporate support to censor the internet… apparently, no one is taking the mainstream propaganda machine seriously anymore, as we look to alternative new sources and independent journalists and bloggers to deliver credible information…

Whatever, bottom line.. get ready everybody for the biggest and possibly most legitimate war the united states will ever have to fight since wwII. This time the odds are stacked against us, as they have indoctrinated many of us into a life of compliance, comfort and stupidity, while they gave themselves unlimited powers, and armed themselves to the britches. Lets only hope the that the soldiers didn’t allow themselves to be brainwashed, as it appears has happened to many police departments…safety and peace… props OWS! props TP…. lets focus here…

  7. Dogood says:

Do we have any idea how congress will view this bill and what, if any, changes they will make?

Should we be reaching out to them to help them understand what this bill really says?

The bill as written is very scary. For crying out loud, I’ll be hunted down according to this criteria.

I value my freedom greatly and having the senate pass this bill diminishes even more my confidence in them.

This bill, well, all I can say is: GULP.

  8. Wolfie0827 says:

Hey Spyder, it’s your twin with hair from TSC.

good breakdown, hopefully people will realize how serious this is getting and get off their butts and oppose it.

  9. smitd says:

Just because I am paranoid doesn’t mean I am not being watched….
Spyder- Now we know we are being watched–They been collecting the data –Patriot act now they want to move on it….
